1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the website operated by Romanos Renovations & Contracting ("Company", "we", "us", or "our"), located at romanosrenovations.ca, and any renovation or contracting services we provide to you ("Services").

By accessing our website or entering into a service agreement with us, you agree to be bound by these Terms. If you do not agree, do not use our website or engage our services.

2. Services

Romanos Renovations & Contracting provides residential renovation and contracting services in Toronto and the Greater Toronto Area (GTA), including but not limited to kitchen renovations, bathroom renovations, basement finishing, full home renovations, and fencing.

All Services are subject to a separate written agreement or contract between you and the Company. These Terms supplement, and do not replace, the terms of any such contract. In the event of a conflict, the written project contract governs.

3. Quotations and Estimates

All written quotations provided by the Company are valid for 30 days from the date of issue unless otherwise stated. A quotation does not constitute a binding contract until both parties have signed a written project agreement and the required deposit has been received.

Estimates or verbal discussions do not create any obligation on the part of either party. Only signed written agreements are binding.

4. Scope of Work and Change Orders

The scope of work is defined in the signed project contract. Any changes to the agreed scope, including additions, deletions, or modifications, must be documented in a written Change Order signed by both parties before the additional work commences.

Change Orders may affect the project price, timeline, or both. No verbal change requests will be honoured. We will not proceed with out-of-scope work without your written approval.

5. Payment Terms

Payment schedules are outlined in the signed project contract and are tied to defined project milestones. Payments are due on or before each milestone as specified in the contract.

Late payments may result in work stoppage and may attract interest at a rate of 2% per month on the outstanding balance, compounded monthly. The Company reserves the right to suspend work until outstanding amounts are received.

All prices are quoted and payable in Canadian dollars. Applicable taxes (HST) are additional unless otherwise stated in writing.

6. Client Responsibilities

You agree to provide the Company with timely access to the property at agreed-upon times, including reasonable access for material deliveries and inspections. Unreasonable delays caused by restricted access may affect the project timeline and may be subject to additional charges.

You are responsible for removing personal property, valuables, and breakable items from the work area prior to commencement. The Company is not liable for damage to items left in the work area.

You are also responsible for ensuring that the Company has all necessary information about the property, including known hazardous materials (asbestos, lead paint, etc.), prior to the start of work. Failure to disclose known hazards may void any warranty and may result in additional costs.

7. Permits and Inspections

Where required by applicable law or municipal regulation, the Company will apply for and manage building permits on your behalf as part of the agreed scope of work. Permit fees are included in the project quote unless otherwise noted.

The client is responsible for ensuring the property is clear of any pre-existing permit violations or outstanding work orders that could affect the issuance of new permits. Additional costs arising from pre-existing violations are not covered under the project contract.

8. Warranties

The Company warrants that all work performed will be completed in a good and workmanlike manner, in accordance with the Ontario Building Code and applicable standards. Any workmanship defects reported within one (1) year of project completion will be addressed at no charge to the client, provided the defect is not caused by misuse, neglect, or third-party modifications.

Materials and fixtures are subject to the manufacturer's warranty. The Company will assist in processing manufacturer warranty claims but is not responsible for defects covered under those warranties.

This warranty does not cover normal wear and tear, damage caused by water ingress from sources outside the renovation scope, or issues arising from the client's failure to maintain the completed work appropriately.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the Services, including loss of use, loss of income, or loss of business opportunity.

The Company's total liability for any claim arising out of or related to the Services shall not exceed the total amount paid by you under the applicable project contract.

10. Website Use

The content on this website is provided for informational purposes only. We make no representations or warranties about the accuracy, completeness, or suitability of the information for any particular purpose.

You may not use this website in any way that could damage, overburden, or impair the website, or interfere with any other party's use of it. Unauthorized use of this website may give rise to a claim for damages or be a criminal offence.

11. Intellectual Property

All content on this website, including text, photographs, logos, and project images, is the property of Romanos Renovations & Contracting and is protected by applicable copyright law. You may not reproduce, distribute, or use any content from this website without our prior written consent.

12. Governing Law

These Terms and any disputes arising from them are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceedings shall be brought exclusively in the courts of Ontario.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted to this page with an updated effective date. Your continued use of the website or engagement of our services after any changes constitutes your acceptance of the revised Terms.
